Terms of Service.

1. Introduction

These Terms and Conditions ("Terms") govern your use of the Nautis mobile application ("the App"), operated by EightTen Labs (Sole Trader) ("we", "us", "our").

By downloading, installing, or using Nautis, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. The Service

Nautis is a digital maritime logbook application that allows you to:

• Record sailing log entries with navigation, weather, and vessel data
• Track your GPS position during trips
• Store photos alongside log entries
• Manage vessels and trip records
• Add friends and view their sailing activity
• Access your data across devices via cloud synchronisation
• Share an active trip publicly via On Watch share links

3. Account Registration

3.1 Who Can Use Nautis

You must be 13 or older to use Nautis. If you're under 18, read these Terms and our Privacy Policy with a parent or guardian before you sign up. We don't check ages when you sign up. If we find out that someone under 13 has an account, we close it and delete its data.

3.2 Account Security

• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You must notify us immediately if you suspect unauthorised access to your account
• We are not liable for any loss resulting from unauthorised use of your account

3.3 Account Information

You agree to provide accurate and complete information when creating your account and to keep it up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.

3.4 Who Can See Your Trips

By accepting these Terms when you create your account, you confirm that you understand the trips you record in Nautis, with their log entries, photos and GPS tracks, can be seen by other Nautis users. Your trips start as Friends, so only your friends see them, and you can choose Everyone or Only me for each trip (§9.1). See also our Privacy Policy §2.8.

4. Acceptable Use

You agree to use Nautis only for its intended purpose as a digital maritime logbook. You must not:

• Use the App for any unlawful purpose
• Attempt to gain unauthorised access to our systems or other users' data
• Upload content that is offensive, harmful, defamatory, or infringes on others' rights
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scrapers) to access the App
• Misrepresent your identity or affiliation
• Use the App to transmit malware or harmful code
• Deliberately submit false or misleading log data

5. Your Content

5.1 Ownership

You retain ownership of all content you create in Nautis, including log entries, trip records, photos, notes, and vessel information ("Your Content"). We do not claim ownership of Your Content.

5.2 Licence to Us

By using Nautis, you grant us a limited, non-exclusive, worldwide licence to store, process, and display Your Content solely for the purpose of providing the Nautis service to you. This includes:

• Storing your data on our servers for synchronisation and backup
• Displaying your data to you across your devices
• Displaying Your Content to other Nautis users as part of the public-by-default visibility model (see §9)
• Serving Your Content via On Watch share links that you generate (see §9.3)

This licence terminates when you delete Your Content or your account.

5.3 Responsibility

You are solely responsible for Your Content. You must ensure that any content you upload does not violate these Terms or any applicable laws.

5.4 What You Can't Post

Nautis has zero tolerance for objectionable content and abusive users. You must not post, upload or share:

• pornography or anything else sexually explicit;
• anything that encourages, promotes or gives instructions for suicide, self-harm or an eating disorder;
• abuse aimed at someone's race, religion, sex, sexual orientation, disability or gender identity, or anything that stirs up hatred against people for those reasons;
• bullying: threatening, humiliating or degrading someone, or ganging up on them;
• anything that encourages, promotes or gives instructions for serious violence against a person;
• realistic images of serious violence or graphic injury, whether to people, animals or imaginary creatures;
• dangerous stunts or challenges likely to get someone seriously hurt;
• anything that encourages people to take a harmful substance, or a harmful amount of anything;
• content that shames people for their body or appearance, or that promotes depression, hopelessness or despair;
• harassment, threats, spam, or anything illegal.

These rules apply to every user, of every age, everywhere in Nautis. We remove content that breaks them, and we may suspend or close the account that posted it without notice.

5.5 Automatic Checks

We check what you share with an automatic tool, OpenAI's moderation service (see Privacy Policy §4).

• What is checked: photos and their captions, profile photos, display names and usernames, trip names and descriptions, departure and destination names, vessel names, and log notes.
• When: as soon as the content reaches our servers, and again whenever you change it. A check every 10 minutes catches anything that was missed.
• How it works: the service rates the content for sexual content (including content involving children), harassment, hate, violence, self-harm and illegal activity. If it flags anything, the content is hidden from everyone else, but you can still see it.
• Photos stay hidden from others until their check has passed. Text shows while its check runs, which usually takes seconds, and is hidden if the check flags it.
• The tool can get things wrong. If you think it hid something that doesn't break these Terms, tell us (§5.8).

5.6 Reporting and Blocking

You can report a photo, a trip or a user from inside the app, or email [email protected]. We review every report within 24 hours. A report leads to one of three outcomes:

• we remove the content;
• we suspend or close the account;
• we take no action, if the content doesn't break these Terms.

We don't send you the outcome.

The person you report isn't told that a report was made or who made it.

Intimate images. If a photo shows you in an intimate way and was shared without your consent, report it with the reason "Sexual content", or email [email protected] with "intimate image" in the subject. We take it down within 24 hours of your report, and we answer any complaint you make about it within 48 hours.

You can also block a user from their profile.

5.7 Illegal Content

We find illegal content through our automatic checks (§5.5), through reports (§5.6) and when we see it ourselves. When we know about it:

• Terrorism content (anything that encourages, supports or glorifies terrorism, or is posted by or for a proscribed organisation): we remove it, close the account and report it to the police.
• Child sexual exploitation and abuse content: we lock it at once so that nobody can see it, the person who posted it included. We close the account and report it to the National Crime Agency, as UK law requires. We keep the records the law requires us to keep.
• Other illegal content (for example threats, harassment and stalking, hate crime, fraud, intimate images shared without consent, and content that encourages suicide or self-harm): we remove it. Serious or repeated cases lead to the account being suspended or closed.

We cooperate with law enforcement.

5.8 Complaints and Appeals

If you think we or our automatic checks got a decision wrong, or you want to complain about content on Nautis or about how we handled a report, email [email protected] with the details.

• Timing: we reply within 7 days, and within 48 hours for a complaint about an intimate image of you (§5.6).
• If we got it wrong: we restore the content or the account.
• If we didn't: we explain why.

These Terms are a contract between you and us. If we remove your content or restrict your account in breach of them, you can bring a claim for breach of contract in the courts of England and Wales (§17).

5.9 Protecting Children

Nautis doesn't check ages and has no part that only adults can use (see §3.1). Some sailing students under 18 use it, so every protection below applies to every user.

• Pornography, and content about suicide, self-harm or eating disorders. Every photo is checked before anyone else can see it, and text is checked as soon as it reaches our servers, usually within seconds (§5.5). The check looks for sexual content and for self-harm, which covers suicide and eating disorders. Anything it flags is hidden from everyone except the person who posted it. If the check misses something that breaks §5.4, we remove it as soon as we find it or someone reports it.
• Abuse and hate, violence, bullying, dangerous stunts and challenges, harmful substances, body shaming and content that promotes despair. Text is checked for abuse, hate, harassment, violence and illegal activity, and photos for violence (§5.5). The check doesn't catch all of these, so reports matter (§5.6). We remove anything that breaks §5.4, whoever posted it.
• Blocking. You can block anyone from their profile. Neither of you then sees the other in search, on the map, on profiles or in feeds.
• Getting help. If you're under 19 and something on Nautis has upset you, or you're worried about yourself or someone else, you can talk to Childline for free on 0800 1111 or at childline.org.uk.
• Complaints. §5.8 explains how to complain about content, or about how we handled a report.

6. GPS Tracking and Location Data

6.1 How GPS Tracking Works

Nautis can track your GPS position during active trips. GPS tracking:

• Is enabled or disabled per trip. You control whether tracking is active
• Operates in the background when enabled, even when the app is minimised or your phone is locked
• Collects position data at regular intervals while a trip is active
• Does not track your location when no trip is active

6.2 Accuracy

GPS accuracy depends on your device, satellite visibility, and environmental conditions. Nautis displays GPS data as received from your device. We do not guarantee the accuracy of any position, speed, or course data. Do not rely on Nautis GPS data for navigation.

6.3 Battery and Data Usage

Background GPS tracking will increase battery consumption and may use mobile data for map tiles. You are responsible for managing your device's battery and data usage.

7. Safety Disclaimers

IMPORTANT SAFETY INFORMATION. PLEASE READ CAREFULLY

7.1 Nautis is NOT a Safety Device

Nautis is a logbook and record-keeping application. It is NOT:

• A navigation aid or chart plotter
• A replacement for proper navigation equipment
• A safety or distress signalling device
• A substitute for a VHF radio, EPIRB, PLB, or AIS
• A replacement for certified maritime safety equipment

7.2 No Reliance for Navigation

Do not rely on Nautis for navigation decisions. Always use proper navigation equipment, up-to-date charts, and follow good seamanship practices. GPS positions shown in Nautis are for logging purposes only.

7.3 Emergency Features

If Nautis includes emergency-related features (such as emergency log entries or safety event recording) in current or future versions:

• These features are for record-keeping purposes only
• They do NOT automatically contact emergency services, the Coastguard, or any rescue organisation
• They do NOT replace proper distress procedures (VHF Channel 16, MAYDAY calls, EPIRB activation)
• We do NOT guarantee that any alert, notification, or message will be delivered
• In an emergency, always use proper maritime distress procedures and contact the relevant Coastguard or rescue service directly

7.4 No Guarantee of Connectivity

Nautis operates offline-first but requires an internet connection for data synchronisation, social features, and notifications. We do not guarantee connectivity at sea. You should never rely on Nautis for any function that requires guaranteed communication.

8. Offline-First Architecture

Nautis is designed to work offline. Your data is stored locally on your device and synced to our servers when an internet connection is available. This means:

• You can create and view logs without an internet connection
• Data may not sync immediately. There may be a delay between creating data and it appearing on our servers
• In the event of a conflict between local and server data, the sync system will attempt to resolve it, but data loss is possible in rare cases
• Local data is lost if you uninstall the app before syncing

9. Who Can See Your Trips, Friends, and Sharing

9.1 Who Can See Your Trips

Every trip has a setting for who can see it. The setting covers the whole trip: its log entries, photos, GPS track and live position.

• Everyone: any Nautis user can see the trip, on the Radar and on your profile. Your friends also see it in their feed.
• Friends: only your friends can see it, in the same places.
• Only me: nobody else can see it. On Watch links you share still work (§9.3).

New trips use your default, which starts as Friends. You can change the default in Settings, pick a different setting when you start a trip, and change it from the trip's menu while the trip is underway. Trips recorded before this setting existed are set to Everyone.

Someone you have blocked can't see your trips, whatever the setting. Your profile (username, name and photo) is visible to other Nautis users whatever you choose for your trips.

When you move a trip to Only me, other users stop seeing it, but we can't take back what they have already seen or saved. You can delete log entries, trips, photos and your account at any time. Once deleted, content is removed from view immediately, and from our servers within 30 days (see Privacy Policy §7).

9.2 Friends

You can add other Nautis users as friends. A friend sees your Friends trips as well as your Everyone trips, and your activity in their feed. You can remove a friend at any time, and they stop seeing your Friends trips.

9.3 On Watch Share Links

Nautis includes a feature called On Watch, which generates a public web link for an active trip. Anyone with the link can view the trip in real-time, including position, course, speed, and any log entries made during the trip. The link is not bound to a specific recipient. Anyone with the link, and anyone they forward it to, can open it.

An On Watch link works whatever you choose in §9.1, Only me included.

On Watch links remain active during and indefinitely after the trip. On Watch link revocation is on the product roadmap; in the meantime, contact [email protected] to disable a link.

10. Changes to the Service

Nautis is under active development. We add, change and sometimes remove features. If a change removes something you rely on, we will tell you in the app first. We may use feedback you send us to improve Nautis, without payment to you.

11. Intellectual Property

• The Nautis name, logo, and branding are the property of EightTen Labs
• The App's source code, design, and functionality are protected by copyright
• You are granted a limited, non-exclusive, non-transferable licence to use the App for its intended purpose
• This licence does not include the right to modify, distribute, or create derivative works from the App

12. Subscriptions and Payments

Nautis offers free and paid tiers:

• Free tier: Core logbook functionality at no cost. We will never paywall core logging.
• Paid tiers (Nautis Plus, Nautis Pro): Additional features available via subscription. Pricing, features, and billing terms will be communicated clearly before purchase.

Subscription management and billing are handled through the Apple App Store or Google Play Store, subject to their respective terms. Refund requests should be directed to the relevant app store.

13. Limitation of Liability

To the maximum extent permitted by law:

• Nautis is provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you for any claims arising from your use of the App is limited to the amount you have paid us in the 12 months preceding the claim, or £50, whichever is greater

We are not liable for any loss or damage resulting from:

• Reliance on GPS data or any data displayed in the App
• Failure of notifications, alerts, or messages to be delivered
• Data loss due to sync failures, device issues, or service interruptions
• Actions taken or not taken based on information in the App
• Any maritime incident, accident, or emergency

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

14. Indemnification

You agree to indemnify and hold harmless EightTen Labs from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

• You may stop using Nautis and delete your account at any time
• We may suspend or terminate your access if you violate these Terms
• We may discontinue the App or any feature at any time with reasonable notice
• Upon termination, your licence to use the App ends immediately
• Sections that by their nature should survive termination will survive (including Limitation of Liability, Indemnification, and Intellectual Property)

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EightTen Labs regarding your use of Nautis.
