1. Introduction

These Terms and Conditions ("Terms") govern your use of the Nautis mobile application ("the App"), operated by EightTen Labs (Sole Trader) ("we", "us", "our").

By downloading, installing, or using Nautis, you agree to be bound by these Terms. If you do not agree, do not use the App.

3.1 Eligibility

Nautis is intended for adult sailors. The App is not designed or marketed for children. If you are under 16, you should have parental consent before using Nautis. We do not currently verify age at signup.

You agree to provide accurate and complete information when creating your account and to keep it up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.

During the alpha and beta phases, access to Nautis may require an invite code. Invite codes are personal and subject to usage limits. We reserve the right to revoke invite codes at any time.

3.5 Public Visibility Acknowledgement

When creating an account, you will be asked to acknowledge separately (by ticking a checkbox provided for this purpose, distinct from your acceptance of these Terms and the Privacy Policy) that you understand log entries, trips, and GPS tracks you record in Nautis are publicly visible to other Nautis users by default. This acknowledgement is a condition of using Nautis during the alpha and beta phases. See our Privacy Policy §2.8 for the full visibility scope.

5.1 Ownership

You retain ownership of all content you create in Nautis, including log entries, trip records, photos, notes, and vessel information ("Your Content"). We do not claim ownership of Your Content.

5.2 Licence to Us

By using Nautis, you grant us a limited, non-exclusive, worldwide licence to store, process, and display Your Content solely for the purpose of providing the Nautis service to you. This includes:

You are solely responsible for Your Content. You must ensure that any content you upload does not violate these Terms or any applicable laws.

6. GPS Tracking and Location Data

6.1 How GPS Tracking Works

Nautis can track your GPS position during active trips. GPS tracking:

GPS accuracy depends on your device, satellite visibility, and environmental conditions. Nautis displays GPS data as received from your device. We do not guarantee the accuracy of any position, speed, or course data. Do not rely on Nautis GPS data for navigation.

6.3 Battery and Data Usage

Background GPS tracking will increase battery consumption and may use mobile data for map tiles. You are responsible for managing your device's battery and data usage.

7.1 Nautis is NOT a Safety Device

Nautis is a logbook and record-keeping application. It is NOT:

Do not rely on Nautis for navigation decisions. Always use proper navigation equipment, up-to-date charts, and follow good seamanship practices. GPS positions shown in Nautis are for logging purposes only.

If Nautis includes emergency-related features (such as emergency log entries or safety event recording) in current or future versions:

Nautis operates offline-first but requires an internet connection for data synchronisation, social features, and notifications. We do not guarantee connectivity at sea. You should never rely on Nautis for any function that requires guaranteed communication.

8. Offline-First Architecture

Nautis is designed to work offline. Your data is stored locally on your device and synced to our servers when an internet connection is available. This means:

9. Public Visibility, Friends, and Sharing

9.1 Public Visibility (default)

Log entries, trips, GPS tracks, photos, and trip records you create in Nautis are publicly visible to other Nautis users by default. This includes display in the in-app feed, on the map, and on your public profile.

During the alpha and beta phases of Nautis, we do not offer per-log or per-trip privacy controls. If you do not want a piece of content to be publicly visible, do not record it in Nautis. You can delete log entries, trips, photos, and your account at any time. Once deleted, content is removed from public visibility immediately, and from our servers within 30 days (see Privacy Policy §7).

You acknowledged this public visibility when you created your account (see §3.5).

9.2 Friends

You can add other Nautis users as friends. The friend graph is used for social discovery and for surfacing relevant activity in the in-app feed. Because all logs and trips are already public by default (see §9.1), adding a friend does not change the visibility of your content. You can remove a friend at any time.

9.3 On Watch Share Links

Nautis includes a feature called On Watch, which generates a public web link for an active trip. Anyone with the link can view the trip in real-time, including position, course, speed, and any log entries made during the trip. The link is not bound to a specific recipient. Anyone with the link, and anyone they forward it to, can open it.

On Watch links remain active during and indefinitely after the trip. On Watch link revocation is on the product roadmap; in the meantime, contact [email protected] to disable a link.

You agree to indemnify and hold harmless EightTen Labs from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

We may update these Terms from time to time. We will notify you of significant changes via the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EightTen Labs regarding your use of Nautis.
